STANDARD TERMS AND CONDITIONS OF SALE

1. The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
2. Our invoices are payable within 21 working days, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment by the due date, Rbs racing s.l. reserves the right to request a fixed interest payment amounting to 10% of the sum remaining due. Rbs racing s.l. will be authorized to suspend any provision of services without prior warning in the event of late payment.
3. If a payment is still outstanding more than sixty (60) days after the due payment date, Rbs racing s.l. reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.
4. Certain countries apply withholding at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances can Rbs racing s.l. become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to Rbs racing s.l. in its entirety and does not include any costs relating to the legislation of the country in which the client is located.
5. Rbs racing s.l. undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as being an obligation to achieve results. Rbs racing s.l. cannot under any circumstances, be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer.
6. In order for it to be admissible, Rbs racing s.l. must be notified of any claim by means of a letter sent by recorded delivery to its registered office within 8 days of the delivery of the goods or the provision of the services.
7. All our contractual relations will be governed exclusively by Spain law.

TERMINOS Y CONDICIONES DE VENTA

1. El cliente renuncia de forma expresa a la aplicación de sus propios términos y condiciones generales, incluso cuando estos hayan sido redactados con posterioridad a los presentes. Toda excepción o modificación deberá ser aceptada de forma previa, expresa y por escrito para que tenga validez.

2. Las facturas deberán ser satisfechas en un plazo máximo de 21 días laborables, salvo que en la factura o en el pedido se establezca un plazo distinto. En caso de impago en la fecha de vencimiento, Rbs racing s.l. podrá exigir un interés fijo del 10% sobre el importe pendiente. Asimismo, Rbs racing s.l. quedará facultada para suspender la prestación de cualquier servicio sin necesidad de previo aviso en caso de mora del cliente.

3. Si el impago persiste durante más de sesenta (60) días desde la fecha de vencimiento, Rbs racing s.l. podrá encomendar la gestión del cobro a una empresa especializada. Todos los gastos legales y de recobro serán íntegramente asumidos por el cliente.

4. Determinados países aplican retenciones fiscales en origen conforme a su normativa interna. Cualquier importe retenido deberá ser ingresado por el cliente ante las autoridades fiscales correspondientes. Rbs racing s.l. no asumirá en ningún caso costes derivados de la legislación fiscal del país del cliente. En consecuencia, el importe íntegro de la factura será exigible a Rbs racing s.l. sin deducción alguna.

5. Rbs racing s.l. se compromete a emplear los medios necesarios para prestar servicios eficientes y dentro de los plazos acordados, sin que ello constituya una obligación de resultado. En ningún caso podrá exigirse a Rbs racing s.l. que intervenga como tercero en reclamaciones por daños formuladas por consumidores finales contra el cliente.

6. Toda reclamación deberá ser notificada a Rbs racing s.l. mediante carta certificada remitida a su domicilio social dentro de los 8 días siguientes a la entrega de los bienes o a la prestación de los servicios, para que sea considerada válida.

7. Todas las relaciones contractuales quedarán sometidas exclusivamente a la Ley Española.
